2015 EU Regulation. Do I need to make a new Spanish Will?

Since EU law has implications for those living permanently in another country. The Regulation EU 650/2012 states:

“EU citizens habitually residing in Spain (residents) will be subject to the Spanish succession law, despite their nationality, unless they specifically state in their will the wish for the succession law of their country of origin to apply”.

The law that applies from August 17th 2015 is already causing concern in international communities. People who have perhaps not heard about Spanish succession law before are now wondering what it is and how it might affect their inheritance plans.

Spanish succession law is very different to the inheritance laws in the UK, Norway, Denmark, etc… In the UK, for example, you can leave your property to however you wish. If you don´t make a will your property goes to your next of kin. In Spain there is more external control over who inherits your belongings and we operate a system of “forced heirs”.
